Terms and Conditions


Welcome to our website, www.safeap.co.uk (“Website”) and to the SafeAP mobile application and the SafeAPractitioner (diary and management tool) mobile application (“Apps”). 


Please read our terms and conditions (“Terms and Conditions”) carefully before you start to use our Website or our Apps and before booking any third-party goods or services through our Website and/or our Apps. Use of our Website and/or our Apps includes accessing it, perusing it, or using any of the functionality offered via it. If you are under the age of 18, you are not eligible to use these services. 


By using our Website and/or our Apps, you confirm that you accept these Terms and Conditions and that you agree to comply with them. YOU ACKNOWLEDGE AND AGREE THAT OUR WEBSITE CONTENT IS PROVIDED SOLELY FOR YOUR INFORMATION. THE CONTENT DOES NOT PROVIDE YOU WITH ANY ADVICE OR RECOMMENDATION OF ANY KIND AND MUST NEVER BE USED AS A SUBSTITUTE FOR ADVICE PROVIDED BY A DOCTOR OR OTHER QUALIFIED HEALTHCARE PROFESSIONALS. If you do not agree to these Terms and Conditions, you must not use our Website and/or our Apps.


1. General Terms and Conditions

1.1 Definitions:  

“Aesthetic Services” means the medical advice, treatment, assistance, procedure or other services in relation to non-surgical aesthetics to be provided by a Practitioner to a Client;

"Apps" means the SafeAP marketplace booking application and SafeAPractitioner diary and management tool application on iOS and Android;

"Booking Terms and Conditions" has the meaning given to such term in clause 1.3(c);;

"Business Day" means a day other than a Sunday or public holiday in England when banks in London are open for business;

"Client" means any person who purchases or receives the Aesthetic Services via our Website and/or our Apps;

“Content” means all audio, video, text, images or other content and information made available by us to you through the Platform and may include content which is owned or controlled by third parties which we are permitted to make available to you through the Platform;

"Practitioner" means the healthcare practitioner, who enters into the Practitioner Terms of Business with SafeAP acting on behalf of itself and all its employees who provides goods, offer their goods and services for sale via our Website or App; 

Privacy & Cookies Policy” has the meaning given to such term in clause 1.3(b);

"SafeAP, us, we or our" means SN &SP Ltd (t/a SafeAP), a company registered in England under company number 12139259;

“Services” website and app functions as describe in clause 1.2;

"Website" means the www.safeap.co.uk

Website & App Terms of Use” has the meaning given to such term in clause 1.3(a); and

"You" and "your" means you as a user of our Website and/or our Apps.

 

  1. Website and our Apps have two main functions/services : 

  1. aggregating information and providing a centralised booking point for aesthetic service providers who wish to offer their goods and services for sale via our Website and our Apps; and  

  2. provision of general information relating to aesthetics.


  1. We have set out the terms under which we are providing you with access to our Website and/or our Apps and any products or services we offer from our Website and/or our Apps. These include the terms and conditions that govern: 

  1. your right to use and link to our Website and/or our Apps (these "Website & App Terms of Use");

  2. how we will use and protect information about you (our "Privacy & Cookies Policy"); and 

  3. our booking terms and conditions in relation to the third party products or services we offer from our Website and/or our Apps (our "Booking Terms and Conditions").


  1. We can only provide the services in accordance with these Terms and Conditions if you provide us with the accurate information to help you. You must be careful that:

  1. any information you give to us or a Practitioner, or enter onto our Apps is accurate; 

  2. if you have any concerns about the information we provide you or any information in our Apps and/or our Website, you seek further medical advice;

  3. you follow any instructions you are given by Practitioners;

  4. you report any adverse or unexpected effects of treatments to us immediately in writing; 

  5. you tell us as soon as reasonably practicable if any of our information about you is or becomes inaccurate or incomplete; 

  6. you use our services only for yourself.


  1. You are eligible to use our Website and/or our Apps if you can confirm that you are of legal age and are of legal capacity to agree to our Terms and Conditions. You are not eligible to use this service if you are under the age of 18.


  1. Please note that these Term and Conditions do not govern the relationship as between SafeAP and our Practitioners. If you are an existing Practitioner, please check the Practitioner Terms of Business provided to you upon signing up. If you are not yet a Practitioner but would like to apply to SafeAP to become one of our Practitioners, please visit www.safeap.co.uk


  1. If you enter any prize competitions or other promotions on our Website and/or our Apps, separate terms and conditions may also apply in addition to our Terms and Conditions. 


  1. In the event of a conflict between any additional terms and conditions and our Terms and Conditions, additional terms shall prevail to the extent of the conflict. 


  1. We may change our Terms and Policies from time to time, in which case up to date versions of such Terms and Policies will be available via our Website and/or our Apps. You should check these Terms and Policies regularly to ensure that you accept any such changes. 


  1. You will be deemed to have accepted any changes to the Terms and Conditions our Website and/or our Apps and/or if you continue to access or use our Website and/or our Apps, where the updated Terms and Policies will be available for you to view. 


  1. By using our Website and/or Apps, you confirm that you accept these Terms and Conditions of use and that you agree to comply with them. We recommend that you print a copy of these Terms and Conditions for future reference.




  1. Website & App Terms of Use  

  1. The Website & App Terms of Use set out how you may use our Website and/or our Apps. By accessing our Website and/or our Apps, you agree to the Website & Apps Terms of Use set out in this clause 


  1. If you do not agree to the Website & App Terms of Use, you should not use our Website and/or our Apps. You should read the Website & App Terms of Use prior to using our Website and/or our Apps. 


  1. SafeAP allows you to search for Practitioners by location, or treatment provided and to schedule appointments with Practitioners via instant messaging service or the online booking system. You may also access information on Practitioners and their practices, post opinions and ratings in relation to their practice and pay for the relevant service using out payment portal


  1. Access to our Website and/or Apps is permitted on a temporary basis and we reserve the right to withdraw or amend our Website and/or Apps without notice. 


  1. Please note that certain sections of our Website and/or Apps are viewable without registering with us, but to actively participate, post opinions or ratings or store your information, you must register as a Client. We will not be liable if for any reason our Website and/or Apps is unavailable at any time or for any period.


  1. From time to time, we may restrict access to all or some parts of our Website and/or Apps to Users who have registered with us.


  1.  You are responsible for making all arrangements necessary for you to have access to our Website and/or App. You are also responsible for ensuring that all persons who access our Website through your internet connection are aware of the Website & Apps Terms of Use and that they comply with them.


  1. You must not misuse our Website and/or Apps by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Website and/or App, the server on which our Website and/or Apps is hosted, or any server, computer or database connected to our Website and/or Apps. You must not attack our Website and/or Apps via a denial-of-service attack or a distributed denial-of-service attack.


  1.  If you breach clause 2.9, you will be committing a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, we reserve the right to immediately cease your right to use our Website and/or Apps.


  1.  We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Website and/or Apps or to your downloading of any Content, or on any website linked to it.


3. Bookings with Practitioners

  1. The Content on our Website and/or Apps is provided for education, scheduling, payment, communication and general information only. The Content provided on our Website and/or our Apps about the Practitioners have either been obtained by SafeAP from generally available public records and databases, written by SafeAP from publicly available information and databases, or have been submitted to us by the Practitioners.


  1. SafeAP requires Practitioners:

  1. to ensure that any Content the Practitioner provide to us is accurate, complete and truthful

  2. to use their best efforts to update the Content on our Website and/or Apps

  3. to ensure that Aesthetic Practitioners who participate on our Website hold active licences (GMC, NMC, GDC) as required by relevant laws to practice, disclosure and barring service (DBS) clearance, professional qualifications, and appropriate indemnity insurance required to provide Aesthetic Services.


  1. SafeAP acts in its capacity as an agent and does not employ any of the Practitioners nor will it be held liable for them. 


  1. SafeAP makes no representations, warranties or guarantees, whether express or implied, that the Content on our Website and/or our Apps is accurate, complete or up to date. 


  1. Further, we make no claim as to any Practitioners’ professional qualifications, expertise, eligibility, quality of work, price or cost information, insurance coverage or insurance fee assurance, benefit information or other Content. In no event shall we be liable to you or anyone else for any decision made or action taken by you in reliance on any such Content.


  1. It is the sole responsibility of the Practitioner to be eligible and capable of providing the appropriate Aesthetic Services.


  1.  You are ultimately responsible for choosing your own Practitioner. Any arrangement, booking or contract for the provision of medical advice, assistance, diagnosis, treatment or procedure with any Practitioner listed on our Website and/or our App is made directly between you and the Practitioner and SafeAP is not a party to such arrangement, booking or contract. You acknowledge and agree that any complaint, grievance or any claim you may have that is in any way connected with a Practitioner and/or Practitioner’s practice must be addressed and/or brought directly against the Practitioner and/or their practice and not against SafeAP.


  1. Please note that the Content on our Website and/or our Apps is provided solely for your information. The Content does not provide you with any advice or recommendation of any kind and must never be used as a substitute for, nor does it replace, professional medical advice, diagnosis, assistance or treatment or procedure. Nothing stated or posted on our Website and/or our Apps is intended to be and must not be taken to be the practice of medicine or other professional healthcare advice or the provision of medical care. Do not disregard, avoid or delay obtaining medical advice from a qualified healthcare provider based on what you have read on our Website and do not use our Website for emergency medical care or needs.   1. Practitioners listed on our Website and/or our Apps with whom you may book appointments, enter into contracts with us, and may pay us a fee in order to be marketed through our Website. We will provide you with Content about the Practitioners who may be suitable to provide the Aesthetic Service you seek based on information that you provide to us such as geographical location and treatments required.


  1. To assist you in locating a Practitioner and to enable the maximum choice and diversity of the Practitioner participating in the services provided on our Website and/or  our Apps, your search results may also be based on other criteria.


  1. You remain liable for any fees or costs or other liabilities that you incur with a Practitioner. If, after you have booked an appointment with the Practitioner and, for whatever reason you fail to turn up to the appointment and/or you cancel the appointment, then you may be liable to any charges and/or penalties that is listed in our Booking Terms and Conditions.


4. Review of aesthetic services

  1. You have the opportunity to submit feedback regarding your experience with Practitioners featured through our Website and/or our Apps. 


  1. You must act responsibly when submitting any feedback and in particular you must not submit any review which is false, deceptive or misleading. You shall only be permitted to submit one review per appointment with the relevant Practitioner. 


  1. We reserve the right to assess the source of any reviews (which includes identifying the IP address of any reviews submitted) and may delete multiple reviews which we believe originate from the same User. You are solely responsible for any reviews submitted by you or from your account.


  1. There may be a delay before any review is published. We may, but we are not obliged to, check your review for inappropriate content or expletives and we do not edit your review or star rating. 


  1. We reserve the right not to upload your review or remove any uploaded review at our sole discretion. This may include, without limitation, removing any review which;

  1. is obscene, hateful, inflammatory, offensive or in any other way falls below commonly accepted standards of taste and decency in the UK 

  2. is reasonably likely to harass, upset, embarrass or alarm a person (including, by way of example only, so called "trolling" or cyber-bullying);

  3. is threatening, abusive or invades another's privacy, or cause annoyance, inconvenience or anxiety

  4. is sexually explicit

  5. advocates, promotes, assists or depicts violence

  6. advocates, promotes or assists any illegal activity or unlawful act or omission

  7. could be deemed to be unsolicited or unauthorised advertising, promotional material, junk mail, or spam (including without limitation chain letters, pyramid schemes or other forms of solicitation or advertisements, commercial or otherwise)

  8. suggest or imply that SafeAP has provided any Practitioner services or in any other way misrepresents the relationship between SafeAP and any Practitioner

  9. or where the review relates to services not provided by the relevant Practitioner (such as reviews which relate to SafeAP’s services)


  1. Reviews and opinions submitted by Clients are those of the individual submitting reviews, not those of SafeAP and we accept no responsibility for the content of such reviews. 


  1. However, if you consider any review on our Website or any Client to be offensive, discriminatory, defamatory or otherwise inappropriate, please notify us of such review by sending us details of the review you consider to be inappropriate and the reason why you consider such review to be inappropriate. Practitioners shall also be able to respond to reviews posted on our Website which concern them.


  1. Upon receipt of notification that any review is considered to be inappropriate, we will evaluate such review and, in our sole discretion, shall decide whether to remove such Content from our Website.


5. Password and Account Security 

  1. You are responsible for the safety and security of your password and log in details. To help protect against unauthorised access to your account you are advised to store your username(s) and password(s) safely and securely.


  1. Please ensure that your password is not one you have used before, that it is six characters or more and, ideally, not one that you use on other websites. 


  1. We recommend that you refrain from disclosing your username(s) and password(s) to anyone. We also recommend that you sign out of your account at the end of each session. 


  1. If you suspect that unauthorised access has been made to your account, you must notify us immediately in writing. We will investigate any alleged unauthorised account activity. Notwithstanding any other terms pertaining to our right to disable or block access to your account, we reserve the right to disable or block your account at any time where it is suspected that unauthorised access has been made to your account. 


6. Intellectual Property

  1. SafeAP is the owner and/or the licensee of all intellectual property rights inherent in our Website and/or our Apps, and in the material published on it including, but not limited to, texts, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software.  Unless specifically stated otherwise, nothing in these Terms and Conditions shall give effect to any transfer of such intellectual property rights from us to you.


  1. Your sole right to use the intellectual property inherent in our Website and/or Apps is a non-exclusive licence to make use of such content only as is strictly necessary to enable you to access our Website and/or our Apps and to peruse its contents.


  1. You may print off one copy, and may download extracts, of any page(s) from our Website and/or Apps for your personal use and you may draw the attention of others within your organisation to content posted on our Website and/or our Apps.


  1. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.


  1. Our status (and that of any identified contributors) as the authors of content on our Website and/or our Apps must always be acknowledged.


  1. You must not use any part of the content on our Website and/or our Apps for commercial purposes without obtaining a licence to do so from us or our licensors.


  1. If you print off, copy or download any part of our Website and/or Apps in breach of these Terms and Conditions, your right to use our Website and/or Apps will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.  


7. Limitation of our liability

  1. Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.


  1. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Website or any Content on it, whether expressed or implied.


  1.  We will not be liable to any Client for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  1. use of, or inability to use, our Website and/or Apps; or use of or reliance on any Content displayed on our Website.

  2. We will not be liable for any loss or damage caused by a virus, distributed denial-of- service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Website or to your downloading of any Content on it, or on any website linked to it.


  1. We assume no responsibility for the content of the websites linked on our Website. Such links should not be interpreted as an endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.


  1. Our maximum aggregate liability under or in connection with these Terms and Condiitons, whether in contract, tort (including negligence) or otherwise, shall in all circumstances be limited to a sum equal to £10 000.


8. Linking to our Website and/or our Apps

  1. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.


  1. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.


  1. You must not establish a link to our Website and/or our Apps in any website that is not owned by you.


  1. Our Website and/or our Apps must not be framed on any other website, nor may you create a link to any part of our Website and/or our Apps other than the home page.


  1. We reserve the right to withdraw linking permission without notice.



9. Third party website links & resources in the Website or Apps

  1. Where our Website and/or our Apps contains links to other sites and resources provided by third parties, these links are provided for your information only.


  1. We have no control over the contents of those sites or resources.


  1. We assume no responsibility for the content of websites linked to or from our Website and/or our Apps. Such links should not be interpreted as an endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.


  1. If you do link from our Website and/or our Apps to other websites, your use thereof will also be subject to those websites’ terms and conditions.



10. Advertising/Sponsorship

  1.  Inclusion of any material in advertisements or sponsors' materials on our Website and/or our Apps does not constitute any guarantee or endorsement as to the quality or value of any of the products or services advertised or any claims made for the products or services by the manufacturer. Any correspondence or dealings which you may have with advertisers or sponsors promoting themselves on our Website and/or our Apps are solely between you and that party. We shall not be responsible or liable for any loss or damage of any kind incurred as a result of any such dealings or as a result of the presence of such advertisers on our Website and/or our Apps.


11. Cancellation/ Termination

11.1 Either party may terminate these Terms and Conditions immediately and without notice to the other party.

 

  1.   You may terminate these Terms and Conditions by deleting your account.


  1.   We may end our agreement with you, subject to applicable regulations:

  1. if the services are unavailable for reasons outside our control

  2. if you do not comply with the conditions on the use of services

  3. if you break any other terms of these Terms and Conditions 


12. Applicable law

12.1 These Terms and Conditions and any non-contractual obligations arising out of, relating to or in connection with it shall be governed by and construed in all respects in accordance with the laws of England and Wales, without regard to any conflict of law principles. 


12.2 If any dispute arises out of, relating to or in connection with these Terms and Conditions, which cannot be settled amicably, we both agree to the exclusive jurisdiction of the courts of England and Wales.
